Auction under 'Sarfaesi Act' or by the orders of 'Debt Recovery Tribunal' (DRT) is a source to buy the mortgaged properties at cheap. Auction sale is a weak sale and it has many a legal flaws. The auction purchasers even after parting with the money, many a times, are caught in legal complications.
But this never means that one may not purchase the properties sold by Banks in auction under the Sarfaesi Act. Only wise decisions and calculated risks should be taken to reduce the chances of loss due to procedural ignorance of the Sarfaesi Act or the negligence on part of the buyers or the Bank, in any case, it is the auction purchaser who suffers.
As they have paid the money and either are unable to get the possession or title of the property purchased in auction, they are caught under fix. Their mind comes in stress.
